Το δικαστήριο έκρινε  ότι τραυματισμός λουόμενου με ταχύπλοο σκάφος με υπαιτιότητα του κυβερνήτου του ο οποίος το είχε ασφαλίσει για την αστική ευθύνη έναντι τρίτων  δεν μπορεί να οδηγήσει σε απαλλαγή ασφαλιστή λόγω ερμηνείας ασαφών όρων της ασφαλιστικής συμβασης  και ειδικότερα επί υπερβασης των νομίμων ορίων πλόων των ταχύπλοων σκαφών.  Στην ασφαλιστική σύμβαση μπορεί με όρους να εξαιρεθούν ορισμένα περιστατικά ή κίνδυνοι αρκεί αυτοί να μην είναι καταχρηστικοί και υπέρμετρα επιβλαβείς για τα συμφέροντα του ασφαλισμένου
