Το Πολυμελές Πρωτοδικείο της Ξάνθης με την με αριθμό 23/2014 απόφαση του έκρινε ως καταχρηστική την ρήτρα που επέβαλε Τράπεζα ως γενικό όρο Συναλλαγών σε σύμβαση στεγαστικού δανείου . Εκρινε συνεπώς άκυρη την ρήτρα με αποτέλεσμα οι καταβολές που ο ενάγων πραγματοποιεί σε ευρώ προς εκπλήρωση των απορρεουσών από την επίδικη σύμβαση υποχρεώσεων του να πρέπει να υπολογίζονται σε ελβετικά φράγκα με βάση την μεταξύ των δύο νομισμάτων συναλλαγματική ισοτιμία που ίσχυε κατά την ημέρα εκταμίσευσης του δανείου.
Σημείωση : Να δούμε την τύχη αυτής στο εφετείο και φυσικά εάν θα ακολουθήοσυν και άλλες αποφάσεις καθότι μέχρι σήμερα τα δικαστήρια είνια αρνητικά . Πάντως αξίζουν συγχαρητήρια στην σύνθεση του ανωτέρω Πρωτοδικείου .
