Το Ευρωπαικό Δικαστήριο δέχθηκε ότι η απόλυση 33χρονου που δούλευε σε κοσμηματοπωλείο και που έπασχε από Aids υπήρξε θύμα διάκρισης βασισμένης στην κατάσταση της υγείας του κατά παραβίαση του άρθρου 14 της ΕΣΔΑ , συνδυαζόμενο και προς το άρθρο 8 αυτής . Έγινε λοιπόν δεκτή η προσφυγή και η Ελλάδα καταδικάστηκε να καταβάλλει στον προσφεύγοντα νεαρό 6.339 Ευρώ για αποζημίωση για υλική ζημία και 8.000 Ευρώ για ηθική βλάβη .Θεώρησε ότι ο Αρειος Πάγος έσφαλε με την σύντομη αιτιολογία για ένα τόσο σοβαρό θέμα, δικαιώνοντας τον εργοδότη διότι αποφασισε να απολύσει τον νεαρό εργαζόμενο για να αποκατασταθεί η ηρεμία μέσα στην επιχείρηση του καθώς και η καλή λειτουργία της .

Πόσες καταδίκες θα υποστεί η ελληνική κοινωνία και πόσα χρόνια θα περάσουν μέχρι να προσαρμοστεί σε αντιρατσιστική αντίληψη και να αντιληφθεί ότι η μετάδοση του Αids γίνεται μόνο με συγκεκριμένο τρόπο . Κατά την γνώμη μας απολυτα ορθή η απόφαση .
