ΟΜΟΡΡΥΘΜΗ ΕΤΑΙΡΙΑ. Διαταγή πληρωμής που εκδόθηκε κατά ομόρρυθμης εταιρίας θεωρείται ότι εκδόθηκε και κατά των εταίρων της. Όταν επιδίδεται η διαταγή στην εταιρία, δικαιούται ο κάθε εταίρος να ασκήσει ανακοπή. Αυτή ασκείται εντός δεκαπενθημέρου από την επίδοση στην εταιρία, ανεξάρτητα από το αν ο εταίρος έλαβε γνώση της επίδοσης. Λόγοι ανακοπής. Η ανακοπή απορρίπτεται ως απαράδεκτη αν ασκηθεί από πρόσωπο κατά του οποίου δεν έχει εκδοθεί η διαταγή πληρωμής ή δεν θα ισχύσει το δεδικασμένο της. Με βάση εκτελεστό τίτλο κατά της ομόρρυθμης εταιρίας γίνεται αναγκαστική εκτέλεση και κατά των εταίρων της. Όταν η διαταγή πληρωμής έχει εκδοθεί και κατά εταίρου, η μη άσκηση από αυτόν ανακοπής κατά της διαταγής πληρωμής του στερεί τη δυνατότητα προβολής, κατά την εκτέλεση, ενστάσεων που αφορούν την απαίτηση και εκείνων που αφορούν τη μη ύπαρξη της εταιρικής του ιδιότητας και ευθύνης του. Όταν η διαταγή πληρωμής έχει εκδοθεί μόνο κατά της εταιρίας, ο αρνούμενος την εταιρική του ιδιότητα παραδεκτά προβάλλει με ανακοπή τις αντιρρήσεις της σε βάρος του επισπευδόμενης αναγκαστικής εκτέλεσης, καίτοι δεν άσκησε ανακοπή κατά της επιδοθείσας και σε αυτόν διαταγής πληρωμής.
