ΠΡΟΣΑΥΞΗΣΗ ΠΕΡΙΟΥΣΙΑΣ. ΑΝΑΔΡΟΜΙΚΟΤΗΤΑ ΑΡΘΡΟΥ 15 ΠΑΡ. 3 Ν 3888/2010. Αβάσιμος ο ισχυρισμός ότι οι διατάξεις του άρθρου 15 παρ. 3 του Ν 3888/2010 δεν έχουν αναδρομική ισχύ και δεν μπορούν να καταλάβουν διαχειριστικές περιόδους πριν το 2010, ως αντικείμενες στο άρθρο 78 παρ. 2 Συντ. Δεν πρόκειται για αναδρομική επιβολή φόρου, αλλά η ρύθμιση της διατάξεως αυτής αποτελεί θεμιτή μέθοδο εξακριβώσεως της πραγματικής φορολογικής ικανότητας, εισάγοντας μάλιστα τεκμήριο, το οποίο αφενός μεν αφορά στην ανεύρεση των πραγματικών εισοδημάτων του ελεύθερου επαγγελματία, αφετέρου δε είναι μαχητό, δυνάμενος ο φορολογούμενος να αποδείξει ότι η επαύξηση της περιουσίας του δεν προέρχεται από την παροχή υπηρεσιών κατά την άσκηση του επαγγέλματός του ως ελεύθερου επαγγελματία, αλλά προέρχεται από άλλη πηγή ή ότι για κάποια νόμιμη αιτία απαλλάσσεται του φόρου ή φορολογείται διαφορετικά. Αβάσιμος και ο ισχυρισμός ότι η διάταξη της παρ. 3 του άρθρου 15 του Ν 3888/2010 παραβιάζει την συνταγματική αρχή της νομιμότητας του φόρου εισοδήματος, που κατοχυρώνεται με το άρθρο 78 παρ. 1 του Συντάγματος, διότι η προσαύξηση περιουσίας από άγνωστη ή μη διαρκή ή μη σταθερή πηγή ουδόλως εντάσσεται εννοιολογικά στο εισόδημα, όπως αυτό κατ’ εφαρμογή της ως άνω συνταγματικής αρχής ορίζεται, σύμφωνα με το άρθρο 4 του Ν 2238/1994. Κατ’ εφαρμογή της συνταγματικής αρχής της νομιμότητας του φόρου, θεσπίστηκε η διάταξη του άρθρου 48 παρ. 3 του Ν 2238/1994, σύμφωνα με την οποία ως εισόδημα από υπηρεσίες ελευθερίων επαγγελμάτων λογίζεται και κάθε εισόδημα που δεν μπορεί να υπαχθεί σε κάποια από τις κατηγορίες Α’ έως Ζ’ της παρ. 2 του άρθρου 4 του Ν 2238/1994. Συνεπώς, η διάταξη του άρθρου 15 παρ. 3 του Ν 3888/2010 όχι μόνο δεν παραβιάζει την ως άνω αρχή, αλλά δίνει τη δυνατότητα στον φορολογούμενο να αποδείξει ότι η προσαύξηση της περιουσίας του δεν υπάγεται στην κατηγορία του εισοδήματος από υπηρεσίες ελευθερίων επαγγελμάτων, (όπως προβλέπεται γενικώς στο άρθρο 48 παρ. 3 του Ν 2238/1994), αλλά ότι είτε προέρχεται από άλλη πηγή ή αιτία, είτε ότι φορολογήθηκε από άλλες διατάξεις είτε ότι απαλλάσσεται από το φόρο με ειδική διάταξη.
