Το Υπουργικό Συμβούλιο της Κύπρου, ενέκρινε το νομοσχέδιο για τις εκποιήσεις ενυπόθηκων ακινήτων, καθώς και το πλαίσιο για την αφερεγγυότητα φυσικών και νομικών προσώπων.

Σημειώνεται ότι, ύστερα από συμφωνία με τους ξένους δανειστές, η πρώτη κατοικία εξαιρείται από τις εκποιήσεις μέχρι το τέλος του χρόνου, οπότε θα εγκριθεί και θα τεθεί σε εφαρμογή το πλαίσιο για την αφερεγγυότητα.

Στο νομοσχέδιο καθορίζεται η διαδικασία εκποιήσεων, ενώ προβλέπεται ότι κατά την αρχική προσπάθεια πώλησης κανένα ενυπόθηκο ακίνητο δεν μπορεί να πωληθεί σε τιμή χαμηλότερη από το 80% της εκτιμημένης αξίας.

Εάν ο πλειστηριασμός δεν καταλήξει σε αποτέλεσμα, ο δανειστής υποχρεούται να καταβάλει νέα προσπάθεια για περίοδο τριών μηνών, ενώ εάν το ενυπόθηκο ακίνητο και πάλι δεν καταφέρει να πωληθεί, η τιμή πώλησής του μπορεί να μειωθεί σε ποσοστό όχι χαμηλότερο από το 50% της αγοραίας αξίας του.
Για σκοπούς καθορισμού της αγοραίας αξίας του ακινήτου, εκτός από τον δανειστή, εκτιμητή θα μπορεί να διορίζει και ο οφειλέτης.

Ο οφειλέτης έχει το δικαίωμα προσφυγής στη δικαιοσύνη κατά τους τέσσερις πρώτους μήνες, «παγώνοντας» προσωρινά τη διαδικασία της εκποίησης.
Ακόμη, η διαδικασία εκποίησης δεν μπορεί να προχωρήσει ενόσω το χρέος βρίσκεται σε διαδικασία αναδιάρθρωσης ή εξετάζεται από τον διαμεσολαβητή.

Το νομοσχέδιο αποτελεί προϋπόθεση για την εκταμίευση της επόμενης δόσης και γι’αυτό θα πρέπει να εγκριθεί από τη Βουλή, πριν από την 1η Σεπτεμβρίου.
